California Energy Commission staff will conduct a public workshop to seek input on staff’s proposed draft regulations to implement the building energy use data access and public disclosure provisions of Assembly Bill 802 (Williams, Chapter 590, Statutes of 2015). Commissioner Andrew McAllister and other Energy Commission Commissioners may be in attendance at the workshop.

Background and Purpose
Assembly Bill 802 revises Public Resources Code Section 25402.10 to require utilities to provide energy consumption data for covered buildings to the owners, owner’s agents, or operators of those buildings upon request, and further requires the Energy Commission to establish a benchmarking and public disclosure program for certain buildings. AB 802 was signed into law by Governor Edmund G. Brown Jr. on October 8, 2015, and went into effect on January 1, 2016. It repealed the Nonresidential Building Energy Use Disclosure Program implemented by the Energy Commission pursuant to Assembly Bill 1103 (Saldana, Chapter 533, Statutes of 2007).
Regulation development for building energy use data access, benchmarking, and public disclosure is currently in the “pre-rulemaking” phase. As needed, pre-rulemaking workshops are held by the Energy Commission to seek early public input for developing and refining draft regulations. The “rulemaking phase” (45-day language) commences with the publication of a Notice of Proposed Regulatory Action and proposed regulations. Once adopted by the Energy Commission, the regulations will be submitted to the Office of Administrative Law for review.
